Brandon Jenner, member of the Kardashian-Jenner clan, and his wife Leah Felder have officially filed for divorce after six years of marriage. Leah made the split official, citing irreconcilable differences as the reasoning for the couple’s demise. Leah is asking for joint custody of their child, as well as spousal support.

The pair dated for eight years prior to getting married in 2012. In Ontario, the period of time that Brandon and Leah cohabited would be relevant to the determination of spousal support. Further, Ontario’s Spousal Support Advisory Guidelines serve as a starting point for the amount and duration of support.

The Guidelines are largely based on the length of cohabitation (married or common law). For married spouses, the formula contemplates time spent cohabiting before and during marriage. Instead of generating a definitive number, the Spousal Support Advisory Guideline formulas provide ranges for the amount of support and duration of payments.

A court can choose to follow the guidelines or depart from them in any particular case. The Guidelines will provide a range and duration for monthly support payments, but spouses are also free to negotiate (and the court has discretion to order) an equivalent lump sum payment instead.
