Should I Rewrite My Will After Divorce? Or After Separation?

You should rewrite your will after separation.

You might think that you should rewrite your will after divorce, but it is important to be proactive and ensure that your assets are in order well before you finally receive that divorce order.

Divorce will affect some provisions in the will, such as any gift of interest in property, the appointment of your former spouse as executor or trustee, and the conferring of a power of appointment will be revoked. However, the beneficiary designations of RRSPs, life insurance policies, and pensions are not affected by separation or divorce. This is why you should review your will and all beneficiary designations to make any changes that you wish.
