On March 17, 2020, Justice Shaw issued an Endorsement pertaining to an urgent motion brought by the Applicant Mother, without notice to the Respondent Father, seeking exclusive possession of the matrimonial home for herself and their three children. The Applicant Mother and the children have not resided in the matrimonial home since December 2019 and have been staying at a hotel.
The Applicant Mother was ordered to provide proper notice of the Motion to the Respondent Father, who shall file materials within two days, by March 19, 2020. The Applicant may then file her reply materials by March 20, 2020 at 10 a.m.
Justice Shaw found the matter to be urgent and thus a teleconference to hear the matter was scheduled for the afternoon of March 20, 2020. As demonstrated by this Endorsement, when a case is deemed urgent, the Court may adopt short turn-around times to ensure a timely resolution.
