E.R. Actress’ divorce settlement: Too favourable?

The once hit show
ER‘s Parminder Nagra is definitely happy after the settlement reached
with her non-famous ex-husband James Stenson. Last year, Stenson sued
Nagra, claiming she was hiding money from her lucrative acting gigs.

According to the parties’ settlement, Stenson is walking away with
very little property-wise, while Nagra is getting the bulk of the goods.

Here’s a quick breakdown of the parties’ settlement: Nagra is keeping
the couple’s California home, which is worth over $700,000, a home
they owned in the UK worth $1.5 million, and a chunk of the proceeds from
the sale of a rental property the couple owned. She also gets three of
the four cars, and ALL of her income, residuals, and royalties from her years on
ER, and appearances in
Alcatraz and
Psych.

So what’s left for Stenson? Well, $450,000 from the sale of the rental
property, $1,226.00 per month in child support for the parties’ 4-year-old child, and his photography business. And last but not least, he gets
to keep the Mazda CX9.

Nagra may want to keep in mind that such one-sided agreements can potentially
be grounds for the agreement to later be set aside. No agreement is absolute,
and regardless of the terms, a party may later bring the agreement to
court to be reviewed. In reviewing the agreement, the court will look
out for any signs that the terms are unconscionable, which is why one-sided
agreements are risky business.

Some further grounds for setting aside agreements are:

  1. Non-disclosure of significant assets and
  2. Failure of a party to understand the nature and consequences of the agreement.
